Please read and confirm the acceptance of the contract terms and sign the car lease contract. It must fulfill all the conditions stipulated below. The company reserves the right to refuse renting a car. The car reservation and renting can only be done by accepting the terms and conditions in the lease contract for the rented car.

1. GENERAL TERMS FOR renting a car
This car lease contract offers you the possibility to use the car for an unlimited number of kilometers, without guarantees (if you choose this variant) and a second driver free of charge!!
Definition of the terms:
Client – refers to the driver mentioned in the contract
Company – refers to Arco Expert
Car – refers to the car which was entrusted to the client for a certain period of time
Damage – any damages, including those to the windows, mirrors, headlights, stops
1.1. It is forbidden to use the vehicle in the following situations:
- to transport passengers for a tax or to take part in car races
- to push or tow any other vehicle
- to drive the car while the driver is under the influence of acohol or narcotic substances
- to perform illegal operations or to transport goods which exceed the maximum load indicated in the car papers
1.2. The vehicle can be driven only by the persons mentioned in the present car lease contract. These persons must be at least 21 years old and to possess a valid driving licence that should be at least one year old.
1.3. The rented vehicle can be driven outside the Romanian borders only with the written agreement of the Company.
1.4. The vehicle cannot be used for advertising purposes. It cannot be written on, decorated etc. (its aspect cannot be modified)
1.5. The client undertakes to keep the vehicle closed and in safe conditions when it is not being used, and to have in his/her possession the car papers, which must not be left inside the vehicle. The client also undertakes to activate the locking devices each time he/she leaves the car after parking it.
1.6. Weekend- From Friday 5 PM to Monday,9 AM.
Any complaint concerning the state of the vehicle must be submitted upon its delivery.
We recommend you to drive carefully especially in the case of certain operations (for example in reverse gear, side parking etc.) as well as in the case of indicators signalling tunnels, bridges, railways!!!

2. MINIMUM RENTAL PERIOD
One day - 24 hours. The rental period begins and ends according to the date and hour set in the car lease contract agreed upon by both parties. In case of announced delays, of up to one hour, no additional cost will be paid, but for delays which exceed one hour, an additional cost stipulated in the contract must be paid.

3. DELIVERY / RECEPTION OF THE VEHICLE
3.1. The delivery and return of the vehicle will be performed at the place, date and hour indicated by the Client and stipulated in the contract without any additional costs, in Bucharest, between 8 am and 9 pm. Between 9 pm and 8 am an extra working hours tax amounting to € 10 will be paid.
The tank will be filled up to 1/4.
3.2. An appendix to this contract (appendix 1) describes the state of the vehicle upon delivery to the client. Any other damage you notice must be mentioned in this document. The vehicle must be returned in the same state according to appendix 1. Unfortunately, no subsequent complaint can be taken into consideration.
3.3. The client undertakes to return the vehicle in the same state as the one it was delivered in (clean, without any scratches / damages, with a tank which is full up to ¼), along with all the associated documents, accessories and equipment, at the date and place set in the contract. In the case of an unannounced delay which exceeds 3 hours, the car will be considered stolen and the Police will be notified.

4. TRAFFIC FINES
All traffic fines resulting from the client’s failure to observe the Romanian laws in force will be paid by the client, including the fines delivered after the rental period has expired (ex. radar, parking fine etc).

5. GUARANTEE
5.1. GUARANTEE – The client is required to pay a guarantee amounting to € 200-800 for all the possible repairs necessary in case of damage to the vehicle, the guarantee will be refunded if the vehicle is returned in good conditions and with a tank filled up to ¼;
The guarantee will be used in order to apply a contract penalty to the Client for damaging the interior or the exterior of the vehicle, penalty which will be proportional with the damages to the vehicle. In addition, the client will have to pay € 250 in case of loss of the ignition key, € 250 in case of loss of the car papers, € 1,5/l in the case the car is returned without the initial amount of fuel.
The guarantee will be repaid if the vehicle is in the same state as the one it was delivered in, along with all the associated documents, accessories and equipment.
A guarantee of € 400 is required for renting a car equipped with a GPS system. The loss or destruction of the GPS navigation system will lead to the loss of the guarantee.

6. PAYMENT
The tariffs for the rented cars are posted in €, including the VAT and insurance for third parties. The payment will be made in RON at the exchange rate of the National Bank of Romania (www.bnr.ro) +2%. The payment by card is accepted at the exchange rate set by the National Bank of Romania +5%. The payment by MasterCard and Visa card is possible when the car is delivered due to a mobile POS.

7. FUEL
The vehicle will be delivered with a tank full up to 1/4, and will be returned with the same amount of fuel in the tank.

8. INSURANCE
8.1. The company has a full CASCO insurance policy for the rented vehicles. The client and the persons accompanying him/her are covered by the personal insurance in case of accident; this insurance is included in the cost of the rented car.
8.2. The client is liable and undertakes to pay all the expenses and the amount of:
a) the damages resulting from inadequate use of the rented car, as well as for the damages to the engine, the gear box or the differential driving gear resulting from a low oil level or from overheating;
b) the damages to the tires or the wheels caused by cuts, punctures or explosion;
c) the damages resulting from the overstress of the components in the electrical wiring;
d) any kind of damages suffered by the rented car as a consequence of driving it on flooded roads;
e) the damages to any car subsystems or components caused by the failure to observe the traffic rules or the traffic safety rules, as well as the rules concerning the transport of the luggage or arrangement of the luggage during the transport;
f) the damages to the seats, mats, upholstery, or other internal elements of the car;
g) the damages to the car resulting from its use in races, contests or training;
h) the damages to the vehicle in case of:
- accidents for which the driver of the rented party is guilty;
- accidents caused by driving under the influence of alcohol, prescription drugs, sleeping pills, or other substances that may affect the driver’s ability to concentrate and to drive, as well as other offences committed while driving on public roads, although these actions did not occur on the public roads, or while other offences where committed;
- if the accident occurs, but the author denies responsibility for the accident;
- theft or theft attempt, which is not confirmed by the Police or if the Police received no complaint concerning a burglary or burglary attempt; if members of the client’s family are involved in stealing or attempting to steal or, in the case of legal persons, members of the representative’s family.
Beware, the car roof impact is not covered by the CASCO insurance.

9. COMPENSATIONS
The company is not liable for accidents caused by the client or the persons accompanying him/her, which may affect the good functioning of the car, as well as for the loss of objects from the car.

10. ACCIDENTS, DAMAGES, THEFT
10.1. The client agrees to defend the interests of the Company and of the insurance company in case of accidents, theft or damages, by:
a) obtaining the names and addresses of eye witnesses and of the parties involved;
b) not abandoning the vehicle unattended;
c) notifying the Company, within 3 hours at most about any incident;
10.2. Documents that have to be obtained in case of accidents, damages or theft
The following documents must be obtained from the Police Station, immediately after the accident or theft, and they must contain:
1. The police report / appendix 2, signed by the police officer who drafted it and sealed, MUST stipulate in case of accident, whether the vehicle was driven under the influence of alcohol;
2. The repair authorization signed by the police officer who drafted it and with the stamp of the Police Section.
In case of failure to present the above mentioned documents or to observe the Romanian laws, the Traffic Laws or the terms of the car lease contract, the Client is liable for all the damages, costs or losses caused to the Company

11. VALIDITY
The contract is valid for the entire duration of the car lease contract, the consequences of the Client’s actions and obligations resulting from the failure to observe the contract clauses may exceed the rental period. Any modification of this contract can only be performed with the written agreement of the parties.

12. JURISDICTION
Any litigation resulting from the interpretation of this car lease contract will be solved by the competent courts of laws in Bucharest. The parties agree that the present contract represents an EXECUTION TITLE for collecting the debts which will be followed by a foreclosure procedure without notification.
